US Appeals Court Temporarily Blocks Decision to Strike Down Mifepristone Approval

April 13, 2023

The US Fifth Circuit of Appeals issued a ruling that temporarily blocks last week’s federal court ruling overturning the approval of mifepristone, a key component for the abortion pill. The pause is temporary, and it may require the US Food and Drug Administration (FDA) to revert to previous rules regarding its distribution.

According to Zachary Brennan, “Other, more recent changes by FDA will also likely be blocked by this court’s order in the interim. That includes the FDA’s decision in 2016 to expand mifepristone’s approval for those at seven weeks’ gestation (to 10 weeks), reduce the number of in-person office visits required for a mifepristone prescription, and eliminate a requirement for prescribers to report “non-fatal adverse events” related to mifepristone.”
