Gilead Reaches $33 M Settlement with Well Care

A $33 million settlement has been reached in Gillead’s 18-month legal battle with Well Care, a healthcare clinic system the pharma giant alleges committed “colossal financial fraud.” Gilead alleges the clinic took advantage of a program meant to give some uninsured people free HIV preexposure prophylaxis (PReP), a drug taken daily that dramatically reduces the risk of contracting or transmitting the virus. Well Care is alleged to recruit so called “placeholder patients”

According to the filing, Well Care was, “prescribing those “patients” medically unnecessary, inappropriate, and often unwanted PrEP medication; falsely certifying to Gilead’s representatives that the prescriptions are medically necessary and appropriate; seeking reimbursement from Gilead, under false pretenses, for the cost of those fraudulently dispensed medications.”
